Consent AI – Terms of Use

Owner/Operator: InsurAI ("InsurAI", "we", "our", "us")
Application: Consent AI ("the App", "the Service")
By accessing or using Consent AI, you ("the User", "you") agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. About Consent AI
Consent AI is a digital automation tool designed to assist insurance brokers and authorised representatives to manage client communications, obtain commission consent, track statuses, and streamline compliance workflows.
Consent AI does not provide financial product advice, legal advice, or insurance recommendations.
2. Eligibility
You must:
- Be over 18 years old
- Be an Australian resident or an authorised representative of an AFSL holder
- Use the Service for legitimate business/work purposes
We may refuse access to any user who violates these Terms.
3. Account Registration
You must:
- Provide accurate and complete information
- Maintain the confidentiality of your login credentials
- Immediately notify us of any unauthorised access
You are responsible for all actions occurring under your account.
4. User Responsibilities
You agree NOT to:
- Upload unlawful, misleading, or harmful content
- Use Consent AI to bypass compliance obligations
- Misrepresent information to clients
- Use the application for spamming, fraud, or unauthorised marketing
- Attempt to reverse-engineer, copy, or resell any part of the Service
You acknowledge that you are solely responsible for verifying the accuracy of client data, disclosures, and communications generated using Consent AI.
5. No Financial, Insurance, or Legal Advice
Consent AI is a workflow tool.
It does not:
- Provide personal or general financial product advice
- Determine insurance suitability
- Replace the expertise of a broker
- Guarantee compliance with AFSL/ASIC requirements
You must obtain professional legal or compliance advice where appropriate.
6. Intellectual Property
All intellectual property in the Consent AI platform, including software, code, UI, branding, documentation, templates, and outputs, is owned by InsurAI Pty Ltd.
You are granted a non-exclusive, non-transferable, revocable licence to use the platform for permitted business purposes only.
7. Fees & Payment
If applicable:
- Subscription fees are billed monthly or annually
- Fees are non-refundable except as required by Australian Consumer Law
- We may change pricing with 30 days' notice
Failure to pay may result in suspension or cancellation of your account.
8. Availability & Service Interruptions
While we strive to maintain 24/7 uptime, the Service is provided on an "as-is" and "as-available" basis.
InsurAI does not guarantee uninterrupted service, and we are not liable for downtime caused by:
- Network interruptions
- Third-party providers
- Maintenance
- Events beyond our control
9. Data Accuracy & Reliance
Consent AI generates messages, workflows, and prompts based on the information you provide.
We do not guarantee:
- Accuracy
- Completeness
- Compliance sufficiency
- Automatic satisfaction of regulatory requirements
You must independently verify all client communications.
10. Termination
We may suspend or terminate your access if you:
- Breach these Terms
- Misuse the platform
- Engage in unlawful or unethical behaviour
- Fail to pay subscription fees
You may terminate at any time by ceasing use and closing your account.
11. Limitation of Liability
To the maximum extent permitted by Australian Consumer Law (ACL):
- InsurAI is not liable for loss of profits, lost data, business interruption, reputational damage, or consequential loss.
- Our total liability for any claim shall not exceed the amount you paid in the preceding 30 days.
- We are not responsible for any misuse of the Service by you or your staff.
You agree to indemnify InsurAI against any claim arising from your:
- negligence
- breach of AFSL obligations
- non-compliant disclosure practices
- miscommunication with clients
Nothing in these Terms excludes non-excludable consumer guarantees under Australian law.
12. Third-Party Integrations
Consent AI may integrate with third-party services (email, SMS, cloud hosting, identity providers).
We do not control these services and are not responsible for:
- their uptime
- their data security
- their terms and privacy practices
13. Governing Law
These Terms are governed by the laws of Tasmania and the Commonwealth of Australia.
Any disputes shall be resolved exclusively in Australian courts.
